According to what we know, that's correct. But that's not what onefortheroad's letter from HMRC is saying.

That's why I'm asking if anyone else can confirm it.

Yeah, that's my interpretation too. As soon as you cease to "hold" it, either by selling it or consuming it, then duty becomes payable.

What are people opinions on the payment of duty by a cooperative? I've had an idea for some sort of beer club where a number of people invest in equipment, ingredients and premises and make beer for the consumption of members, friends and family. No, money will be paid for the beer, and every member must help out on each brew in some way.

I'm sure there is a bloke on here who used to run a place like that.

It had decent sized vessels and all folk did was bring their ingredients, or he might have supplied them, they made the beer on the equipment then took it away. It was perfectly legal. I think they basically paid a small fee to use the equipment and the 'leccy.

It might have been mixbrewery, but I can't remember, just I saw some pictures of it once.

You could be right. You can still register as a homebrewer, and not pay any duty.

Maybe I am misinterpreting onefortheroad's quote. It needs to in be in context, really.

Hopefully onefortheroad can clarify.
