I have one from Rob, and it's great. But why didn't they make it a little taller and fit a valve on the bottom of the cone?

A conical then? The reason is simple, that added bit of manufacture costs a lot. The bucket is a simple spun piece of steel, attaching that bottom ferrule or clamp fitting costs a fortune, you then need taller legs in different places because of the height and the poor balance.

Someone is trying to get a budget conical together but the cost will still be greater than what this bucket is trying to achieve.

what is the maximum size this will hold.can you fit 23 litres in

26.3 capacity but I don't know if that's to the brim. I've not brewed in it yet.

if that is brim then 23 litres may still be ok ,if not blow off tube required.
